Acceptable Use and Privacy Policy
In addition to the ExpressApps
Terms and Conditions
published on this web site and any other terms applied in our Master Service
Agreement the following items define our acceptable use and privacy policy for
Hosted Applications and Managed Exchange solutions.
Acceptable Use Policy
The Customer agrees
to be bound by these conditions of use to access our Service.
The Customer shall comply with all reasonable
directions given by ExpressApps from time to time in connection with the use of
the Service.
Unless supplied by ExpressApps under a separate Service
Order, The Customer is responsible for their connection to the internet to
access our service.
It is the Customer’s
responsibility to ensure their connection to our service is secure. ExpressApps
is not liable for any breaches because the security of the Customer’s computer,
network or connection has been compromised.
In contracting with
ExpressApps for Services, the Customer obtains no rights to the hardware and
other infrastructure and facilities used by ExpressApps to deliver the Service,
unless otherwise agreed in writing.
The Customer
indemnifies and agrees to keep indemnified ExpressApps from and against all
actions, claims, suits, demands, liabilities, costs or expenses arising out of
or in any way connected to the use of the Service. This indemnity is a
continuing obligation separate from any other obligations under the terms and
conditions for use of the service and will continue despite termination of use
for whatever reason.
The Customer must
not use nor permit any other party to use the Service for any activity which, in
the reasonable opinion of ExpressApps, constitutes an unacceptable use of the
Service. Unacceptable use includes, but is not limited to, such activities as
spamming or denial of service attacks. Unacceptable use prohibits at least the
following conduct in relation to the use of the Service (this list is not
exhaustive):

deliberately or unintentionally
disrupting the ExpressApps service, or engaging in any activity likely to
disrupt any ExpressApps service;

giving an unauthorised person
account and password details;

to access, send mail or publish
material that is defamatory, obscene, offensive, abusive, pornographic,
menacing, or impermissible under any code or law at any place where
transmissions are sent from or viewed;

to harass, threaten or cause a
nuisance to anyone;
-
to commit a crime or in the
process of committing a crime;
-
to distribute computer viruses;
-
in connection with infringement
of the intellectual property or other rights of any person including
(without limitation) the distribution of unlicensed computer software;
-
to send unsolicited bulk
electronic messages or permit mass distribution of advertising material,
except to people who have consented to the receipt of that material;
-
to interfere with, damage,
disrupt or unlawfully use or gain access to any service, equipment or
computer network;
-
to do anything that may
jeopardize the security or integrity of any part of the ExpressApps network; or
-
to engage in any activities in
such a manner as to expose ExpressApps to a liability.
Privacy Information
ExpressApps collects information from
Customers in order for us to provide our Services. We will take all reasonable
steps to ensure that the Customer’s information is secure at all times from
loss, disclosure, modification and misuse. Our members of staff are required to
adhere to a confidentiality agreement that is binding upon them at the time of
their employment and after their termination. Our information technology
systems and premises are the subject of stringent security controls at all
times.
As part of routine
administration, ExpressApps collects system status information such as login
times and help desk records. ExpressApps will not provide any information on
the Customer to any other organisation or individual without the Customer's
express permission or legal compulsion such as a Court order.
ExpressApps will
comply with the Federal Privacy Commissioner's prevailing Privacy Principles in
all respects, and in particular will not misuse Customer’s information for
marketing.
Where ExpressApps
provides Managed Exchange or other hosted email as part of the Service we will
respect the integrity of the contents of the Customer’s email. Except as
required or as directed by the Customer to release blocked emails at no time do
any of our staff examine the contents of any email transmissions.
All Customers may
request access to the information collected by ExpressApps in relation to
themselves and the use of the Account owned by them. ExpressApps wishes to
ensure that such details are always correct and up-to-date, and will amend any
inaccuracies or changes to details on request.
ExpressApps keeps
client information on controlled facilities which are secured against
unauthorised access. Proof of identity will be required before information is
released to any person, including the Customer.
